How long does it take?

This depends on the complexity of your claim. As a guide, – to reclaim excessive unfair charges could take as little as 3 months. Payment Protection Insurance claims that the Bank agree to settle based on the original letter of claim can take anything from 4-6 weeks to 6 months dependant on the Lender. Claims that the Lender rejects can be submitted to the Financial Ombudsman. We understand there is a substantial back log at the Financial Ombudsman Service which can mean claims can take between 6 months and 2 years to settle. Beware of exaggerated claims i.e. “We can get you paid by Christmas”.

Am I Liable for any costs?

In areas of Claims such as Mortgage Mis- Selling or Interest Rate Swap Agreements we may recommend you to a firm who will represent you on a No Win No Fee basis. You would have a separate fee agreement with the Law firm which may or may not include a liability for costs. In our experience the agreement will normally cover your liability to costs under an Insurance Policy. Before signing any agreement with a Solicitor make sure you fully understand what is covered in the policy.

Can I do it myself?

Yes of course you can. If your claim is only for a small amount this would be our recommendation. There are a number of websites offering advice and templates of letters to assist you. Consumer Legislation and the Financial Services Handbook which contain all the Regulators and Principle Lenders must adhere to are extremely complex. You may well feel it’s worth using a Claim Management Company as a convenient way to submit a claim, even though naturally enough there will be a Fee to pay if your claim is successful.

If I Claim will it effect my credit rating?

No we recommend you continue your repayments as normal until your claim is settled. If you do this your credit rating cannot be affected.If your claim for PPI is successful it is likely your monthly payments to your Lender will go down. You may also receive a cash settlement If your Credit Agreement is finished you will receive a cash settlement if your claim is successful.

Why do some companies charge up front fees and some don't?

Will I have to talk to my lender about this if I claim?

Absolutely not. Once your application to claim is received including your letter authorising us to act on your behalf, your Lender will be informed to correspond with us on this matter only. If the Lender wishes to communicate with you on other matters they can of course do so. If your Lender does contact you directly about your claim politely ask them to contact us.

If I am in a Debt Management or IVA programme can I still claim?

Yes you can. There are no legal reasons why you cannot pursue a claim.
